Schedules of Condition & Dilapidations
Whether you are a Landlord or a Tenant, professional advice should always be sought prior to leasing a residential or commercial property. This is ‘advice that pays’ in avoiding costly litigation when the lease ends.
Prior to signing a new lease, it is essential to fully understand the requirements of the tenant liabilities and the financial implications of not complying with them.
You may be required to have a Schedule of Condition prepared on the building. This is a ‘snap-shot’ of the property’s condition at the commencement of the Lease. Our chartered surveyors are experienced in preparing detailed Schedules of Condition, which can be appended and referenced within a new lease.
When approaching the end of the term, the Landlord will require the preparation of a Terminal Schedule of Dilapidations or, in other words, a list of items where it is felt that the occupier has not met with their covenants etc.
Acting for Landlord or Tenant clients, Kirkby Diamond have the experience to assist with the preparation or review of a Schedule of Dilapidations, which will lead to a fair financial settlement.
Party Wall Matters
Kirkby Diamond’s Party Wall specialists are well versed in the details of the legislation, advising on the preparation and review of the most appropriate notification, and then advising on the requirements to draft and agree a Party Wall Award.
When the Building Owner (B.O.) proposes to carry out any works that will trigger the act, the B.O. must give Notice to the Adjoining Owner (A.O.) in advance of carrying out the works.
Representing Building or Adjoining Owners, our Building Surveyors will act in accordance with the Party Wall Act to ensure that the duties placed on all parties are followed and discharged.
